These Terms of Service ("Terms") govern your access to and use of the TopStick Golf mobile application and website at topstickgolf.com (collectively, the "Service"), operated by TopStick Golf LLC ("TopStick Golf," "we," "us," or "our"), a Connecticut limited liability company.
By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
To access certain features, you must create an account. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@topstickgolf.com if you suspect unauthorized use of your account.
TopStick Golf is a mobile application that allows users to track golf scores, manage game formats, record friendly competition among players, and access golf-related information and analytics. The Service includes both free features and optional paid subscription features (the "Pro Bundle").
TopStick Golf functions solely as a scorecard and ledger tool. We do not accept, hold, process, or transfer money between users. Any financial settlement between users based on round outcomes is conducted independently by those users outside of the Service.

The Service may be used by players to track informal, friendly competition, including agreed-upon stakes between friends. TopStick Golf does not facilitate, process, or regulate financial wagering. Users are solely responsible for ensuring that any financial arrangements they make with other players comply with applicable laws in their jurisdiction. TopStick Golf disclaims all liability arising from any financial arrangements between users.
Certain features of the Service require a paid subscription ("Pro Bundle"). By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. Subscriptions are billed in advance on a monthly or annual basis and automatically renew unless cancelled. You may cancel your subscription at any time through your account settings in the app. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by applicable law.
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and the TopStick Golf name and mark — are owned by TopStick Golf LLC and are protected by applicable intellectual property laws. You may not use, copy, reproduce, or distribute any part of the Service without our prior written consent.
You retain ownership of any content you submit to the Service (such as scores and notes). By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and display that content as necessary to operate the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TOPSTICK GOLF LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless TopStick Golf LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of laws provisions. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fairfield County, Connecticut, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, by providing notice through the app or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
